TOTO – Every Card Matters
These Terms of Service ("Terms") govern your access to and use of TOTO ("TOTO", "we", "us", or "our"), including the TOTO mobile application, website, and related services (collectively, the "Service").
By creating an account, accessing, or using TOTO, you agree to these Terms. If you do not agree with these Terms, you must not use the Service.
1. About TOTO
TOTO is a business networking and contact-management application designed to help professionals and business owners: • Scan and digitize visiting cards • Extract information from visiting cards • Save and organize business contacts • Categorize contacts • Store visiting-card images • Explore business information through map-based features • Track networking activities and goals • Identify and manage potential business leads • Build and maintain professional relationships TOTO is a productivity and networking tool. It does not guarantee any particular business, networking, sales, or financial outcome.
2. Eligibility
You must be legally capable of entering into a binding agreement to use TOTO. If you use TOTO on behalf of a company, organization, or business, you represent that you have authority to accept these Terms on its behalf. You are responsible for ensuring that your use of TOTO complies with all laws and regulations applicable to you.
3. Account Registration
Certain features require you to create a TOTO account. You agree to: • Provide accurate information • Keep your account information current • Maintain the confidentiality of your login credentials • Not share your account with unauthorized persons • Notify us of suspected unauthorized access • Take reasonable steps to protect your account You are responsible for activity performed through your account unless caused by unauthorized access that was not reasonably within your control. We reserve the right to suspend or restrict accounts involved in fraud, abuse, security violations, or other prohibited activity.
4. Your Content and Data
You may upload, enter, or store information through TOTO, including visiting-card images, names, business information, phone numbers, email addresses, addresses, websites, notes, categories, lead information, follow-up information, and other business networking information. You retain your rights in content that you submit to TOTO, subject to the rights necessary for us to operate the Service. You grant TOTO a limited, non-exclusive right to process, store, transmit, and display your content solely as reasonably necessary to provide the Service and its requested functionality.
5. Visiting Card Scanning
TOTO allows you to capture or upload visiting cards. You understand that: • Card images may be processed using OCR and/or artificial intelligence. • Extracted information may contain errors. • Text, names, numbers, addresses, and other information may be incorrectly recognized. • You should review extracted information before relying on it. TOTO does not guarantee that every field will be accurately extracted. You are responsible for reviewing and correcting information before using it for business purposes.
6. AI-Generated or Extracted Information
TOTO may use artificial intelligence and automated processing to extract or organize information. AI-generated or automatically extracted information should not be treated as guaranteed accurate. TOTO does not guarantee that all information will be detected; that information will always be accurate, complete, or correctly categorized; that addresses will always be correctly interpreted; or that business information will always be current. You remain responsible for verifying information before relying on it.
7. Contacts and Third-Party Information
TOTO allows you to store information about professional contacts. You represent that you have a lawful and appropriate basis for collecting, storing, and using information you provide to TOTO. You must not use TOTO to unlawfully collect, process, distribute, or misuse another person's personal information. You must comply with applicable privacy, data-protection, communications, and marketing laws when contacting people through information stored in TOTO.
8. Device Contacts
Where supported, TOTO may allow you to save information to your device's native contacts. You are responsible for deciding whether to grant TOTO access to device contacts. You should ensure that your use of device-contact information complies with applicable law and the permissions granted by the device owner.
9. Map and Location Features
TOTO may provide map and location-related functionality based on business addresses and other information. Map information may be provided by third-party mapping or geocoding services. TOTO does not guarantee accuracy of map information, accuracy of business locations, availability of businesses, accuracy of addresses, or availability of third-party map services. You should independently verify important location or business information.
10. TOTO Goals
TOTO may provide networking goals intended to encourage consistent networking and lead-generation activities. Examples may include meeting new contacts, scanning visiting cards, following up with contacts, generating potential leads, and building networking habits. Goals, scores, streaks, recommendations, and progress indicators are intended for motivation and productivity. They do not constitute guarantees of leads, sales, revenue, referrals, business relationships, or business success.
11. User Responsibility for Business Decisions
TOTO provides tools for organizing and managing networking information. TOTO does not provide professional advice, legal advice, financial advice, investment advice, or guaranteed sales recommendations. You are solely responsible for decisions made using information stored or displayed through TOTO.
12. Free and Paid Services
TOTO may provide both free and paid functionality. The free service may include a limited number of visiting-card scans. The current free allowance may be 25 scans. TOTO may change free-service limits in accordance with applicable law and reasonable notice.
13. Premium Subscription
TOTO may offer a Premium subscription. The current Premium plan is ₹199 per year. Premium features may include additional or unlimited visiting-card scanning and other features specified within the application. Subscription benefits may change over time. The applicable price, billing period, and included features displayed at the time of purchase will govern the relevant subscription.
14. Payments
Payments may be processed through third-party payment providers. By purchasing a subscription, you authorize the applicable payment provider to process the transaction according to its terms. TOTO does not intentionally store complete payment-card credentials such as card numbers, CVV numbers, or UPI PINs. Payment processing may be subject to the payment provider's own terms and policies.
15. Subscription Renewal and Expiry
Unless otherwise stated during purchase, a subscription may remain active for the period specified at purchase. For an annual subscription, the applicable subscription period is generally 365 days from activation. When a subscription expires or is cancelled, Premium features may become unavailable. Your previously stored data may remain subject to the applicable account and data-retention provisions.
16. Refunds
Refund eligibility depends on the applicable purchase method, payment provider, applicable law, and the circumstances of the transaction. Where a payment is processed through a third-party platform or payment provider, additional refund rules may apply. TOTO reserves the right to investigate suspected fraudulent or abusive refund activity.
17. Acceptable Use
You agree not to use TOTO to: break any applicable law; commit fraud; impersonate another person or organization; upload malicious software; attempt unauthorized access to TOTO systems; circumvent authentication or security controls; access another user's data; scrape or systematically extract private user information; interfere with the operation of the Service; reverse engineer the Service except where legally permitted; abuse APIs or automated systems; upload unlawful or harmful content; harass, threaten, or abuse other individuals; use information obtained through TOTO for unlawful purposes; spam individuals; conduct unlawful marketing or solicitation; or attempt to bypass subscription restrictions or scan limits. We may suspend or terminate accounts that violate these restrictions.
18. Account and Data Security
You must not attempt to access another user's account, contacts, visiting cards, or other private information. TOTO uses technical measures intended to isolate users' data. You acknowledge that no online system can be guaranteed to be completely secure. You should use a strong password and protect your account credentials.
19. Administration of the Service
TOTO may operate a separate web-based administrative system for managing the Service. Administrative personnel may access information necessary to operate the platform, such as account status, subscription information, system usage statistics, and aggregate analytics. Access to users' private visiting-card images and private contact information is restricted according to TOTO's privacy and security architecture.
20. Intellectual Property
The TOTO application, branding, name, logo, design, software, interface, documentation, and other original materials provided by TOTO are owned by or licensed to TOTO and are protected by applicable intellectual-property laws. Except as expressly permitted, you may not copy the TOTO application, reproduce TOTO branding, sell or redistribute the Service, modify or create derivative versions of TOTO, reverse engineer the software where prohibited by law, or use TOTO branding without authorization. Nothing in these Terms transfers ownership of TOTO's intellectual property to you.
21. Feedback
If you provide suggestions, ideas, feature requests, or other feedback regarding TOTO, you agree that we may use that feedback to improve the Service without owing you compensation, unless otherwise agreed in writing.
22. Third-Party Services
TOTO may depend on or integrate with third-party services, including services for AI/OCR processing, cloud hosting, storage, maps and geocoding, authentication, payments, analytics, notifications, and other infrastructure. Third-party services may have their own terms and policies. TOTO is not responsible for third-party services that are outside our reasonable control.
23. Service Availability
We aim to keep TOTO available and reliable, but we do not guarantee uninterrupted availability. The Service may occasionally be unavailable, delayed, interrupted, modified, temporarily restricted, or affected by maintenance, third-party service outages, or network or infrastructure problems. We may modify, suspend, or discontinue features where reasonably necessary.
24. Changes to the Service
We may add, modify, remove, or discontinue features of TOTO. We may also change subscription plans, pricing, limits, or functionality. Where required by applicable law, we will provide appropriate notice of material changes.
25. Account Suspension or Termination
We may suspend or terminate your access if you materially violate these Terms; you engage in fraud or abuse; you compromise platform security; you attempt unauthorized access; your use creates a security or legal risk; required by law; or you engage in conduct that materially harms the Service or other users. You may stop using TOTO at any time. Termination may result in loss of access to your account and stored information.
26. Account Deletion
You may request or initiate account deletion through available account-management functionality. Deleting your account may permanently remove contacts, visiting-card images, goals, lead information, networking history, and account-related data. Certain information may be retained where required or permitted by applicable law, including information necessary for legal, security, fraud-prevention, accounting, or dispute-resolution purposes.
27. Disclaimers
To the maximum extent permitted by applicable law, TOTO is provided on an "as is" and "as available" basis. We do not guarantee that the Service will always be available; that extracted information will always be accurate; that AI/OCR processing will always be correct; that business information will always be current; that map information will always be accurate; that goals will result in leads or sales; that the Service will meet every user's specific requirements; that errors will always be corrected immediately; or that third-party integrations will always function. You use TOTO at your own discretion and risk.
28. Limitation of Liability
To the maximum extent permitted by applicable law, TOTO and its owners, employees, affiliates, service providers, and representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service. This may include loss of business opportunities, revenue, profits, data, goodwill, business relationships, or expected leads. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
29. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless TOTO and its owners, employees, affiliates, and service providers from claims, losses, liabilities, damages, and expenses arising from your violation of these Terms; your unlawful use of the Service; your misuse of another person's information; content you upload or submit; your violation of applicable laws; or your infringement of another person's rights.
30. Privacy
Your use of TOTO is also governed by the TOTO Privacy Policy. The Privacy Policy explains how TOTO collects, uses, stores, processes, and protects information. By using TOTO, you acknowledge that you have reviewed the Privacy Policy.
31. Governing Law
These Terms shall be governed by and interpreted in accordance with the applicable laws of India, without regard to conflict-of-law principles. Any disputes arising in connection with these Terms or the Service shall be subject to the jurisdiction of the courts having appropriate jurisdiction under applicable law.
32. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable, where legally possible. The remaining provisions will continue to remain in effect.
33. Entire Agreement
These Terms, together with the TOTO Privacy Policy and any additional terms presented for specific services or purchases, constitute the agreement governing your use of TOTO. If there is a conflict between these Terms and specific terms presented for a particular paid feature, the specific terms may control that feature to the extent of the conflict.
34. Changes to These Terms
We may update these Terms from time to time. When material changes are made, we may provide notice through the application, website, or another appropriate method. The updated Terms will include a revised "Last Updated" date. Your continued use of TOTO after the updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.
35. Final Principle
TOTO exists to help people turn business cards into meaningful business relationships. Every Card Matters.
